3.Information only, not professional advice
3.1 The content on the Website, including service descriptions, guides and resources, is general information about accounting, taxation, payroll, company administration and related matters. It is provided for general guidance only and does not take your particular circumstances into account. It is not professional accounting, tax, financial or legal advice and should not be relied on as such. TACCSPRO provides professional advice only to clients under a formal written engagement, based on the information supplied by the client and within the scope agreed in that engagement.
3.2 Tax, accounting and company legislation changes often, and every situation is different. Before acting on any information on the Website, please obtain advice for your specific circumstances, for example by booking a consultation with us.
3.3 Although we take reasonable care to keep the Website accurate and up to date, we do not guarantee that the content is complete, current or free of errors. Where dates, rates or thresholds are mentioned, confirm the current position with the relevant authority (such as SARS or CIPC) or with us.
4.No client relationship through the Website
4.1 Using the Website, or submitting an enquiry or consultation request, does not create a client relationship between you and TACCSPRO.
4.2 A professional relationship begins only once we have accepted an engagement in writing, which is usually through an engagement letter setting out the scope, fees and terms of the services. If there is any conflict between these Terms and a signed engagement letter, the engagement letter applies to those services.
4.3 Descriptions of our services on the Website are a general overview and do not form an offer capable of acceptance. In particular, our audit-readiness service is limited to accounting preparation, reconciliation and readiness assistance. TACCSPRO does not issue audit opinions or independent review reports through that service. Statutory audits and independent reviews are carried out by appropriately qualified and authorised independent professionals.
5.Enquiry and consultation forms
5.1 When you use our Contact or Book a Consultation forms, you agree to provide accurate information and to use the forms only for genuine enquiries.
5.2 Please do not send identity documents, banking credentials, passwords or other highly sensitive information through the website forms. If we need sensitive documents, we will arrange a secure way to receive them.
5.3 We aim to respond to enquiries promptly, but we do not guarantee a response time. Submitting a consultation request does not confirm an appointment until we confirm it with you.
5.4 The forms use security measures, including Cloudflare Turnstile, to prevent spam and abuse. Our Privacy Policy explains how enquiry information is processed and kept.
6.Acceptable use
You agree not to:
- use the Website in any way that is unlawful, fraudulent or harmful, or in breach of these Terms;
- attempt to gain unauthorised access to the Website, its servers or any connected systems, or interfere with its security or operation;
- introduce viruses, malware or any other harmful code;
- submit false, misleading, offensive or spam enquiries, or automate submissions to the Website’s forms;
- copy, scrape or harvest content or data from the Website by automated means, except as permitted by search engines’ normal indexing;
- impersonate any person, or misrepresent your connection with any person or organisation.
We may restrict or block access to the Website, or ignore submissions, where we reasonably believe these Terms have been breached.
7.Intellectual property
7.1 The Website and its content, including text, graphics, the TACCSPRO name and logo, the design and layout, are owned by or licensed to TACCSPRO and are protected by South African and international intellectual property laws.
7.2 You may view the Website and print or download extracts for your own personal or internal business reference. You may not reproduce, distribute, modify or commercially use any content, or use our name or logo, without our prior written consent.
7.3 Third-party names and trademarks mentioned on the Website, such as Sage, SARS and CIPC, belong to their respective owners. Referring to them does not imply endorsement, partnership or accreditation unless expressly stated.
8.Third-party websites and services
8.1 The Website may link to third-party websites, for example those of SARS, CIPC, software providers or the Information Regulator. We provide these links for convenience only. We do not control and are not responsible for their content, availability, security or privacy practices.
8.2 The Website relies on third-party service providers for hosting, email delivery and security. Our Privacy Policy describes them.
9.Availability of the Website
We do not guarantee that the Website will always be available, uninterrupted or error-free. We may update, change, suspend or withdraw any part of the Website at any time, for example for maintenance or security reasons, without notice.
10.Limitation of liability
10.1 Subject to applicable South African law, including the Consumer Protection Act 68 of 2008 where it applies, and only to the extent that the law permits, TACCSPRO and its directors, employees and agents are not liable for any loss or damage (whether direct, indirect or consequential) arising from your use of the Website, specifically from:
- your use of, or inability to use, the Website;
- reliance on any information on the Website;
- any error, omission, interruption, delay, virus or other harmful component; or
- third-party websites or services linked to or used by the Website.
This limitation applies only to the Website and its general information, as described in clause 10.3.
10.2 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. This includes liability for gross negligence or wilful misconduct, and any rights you may have under the Consumer Protection Act 68 of 2008 where that Act applies.
10.3 Liability for professional services we provide under an engagement is governed by the relevant engagement letter, not by these Terms.
11.Indemnity
To the extent permitted by applicable law, you agree to indemnify TACCSPRO against reasonable losses, damages and costs (including reasonable legal costs), and against third-party claims, that arise directly from:
- your unlawful use of the Website; or
- your material breach of these Terms.
This indemnity does not apply to the extent that a loss or claim is caused by TACCSPRO’s own negligence or wrongful conduct.
12.Privacy
We process personal information in line with POPIA and our Privacy Policy. By using the Website’s forms, you acknowledge that your information will be processed as described there.
13.Changes to these Terms
We may update these Terms from time to time. Updated Terms will be published on this page with a new effective date. Subject to applicable law, they apply from that published effective date and do not apply retrospectively to your earlier use of the Website. If you continue to use the Website after the effective date, the updated Terms apply to that use.
14.Governing law and disputes
14.1 These Terms are governed by the laws of the Republic of South Africa.
14.2 Please contact us first if you have a concern, so that we can try to resolve it informally.
14.3 Subject to any rights you have under applicable consumer law, you agree to the jurisdiction of the South African courts.
15.General
15.1 Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
15.2 No waiver: if we do not enforce a provision immediately, we have not waived our right to enforce it later.
15.3 Entire terms: these Terms (with the Privacy Policy) are the entire agreement between you and TACCSPRO regarding use of the Website. A signed engagement letter governs any professional services.
